Thank you very much for taking the time to contact Assemblymember Brian Maienschein's District Office and for sharing with us your e-mail. You have shared with us a tremendous amount of information. We are very sorry to hear about your recent small claims court situation.

I might suggest that you contact the City of San Diego Neighborhood Code Compliance and request an investigation. Once a claim is opened and an investigator is assigned to your particular situation. I might suggest that you ask them questions specific to AB 1404 and the "Good Neighbor Fence Act" of 2013. As you are well aware the State of California will pass legislation like AB 1404 however, the local jurisdiction for your community of Mira Mesa is the City of San Diego. The City of San Diego has a Neighborhood Code Compliance Department that is responsible for enforcing the laws that are passed down from Sacramento. I might suggest that you contact your Councilmember Chris Cate or Neighborhood Code Compliance.

If your neighbor has committed a viloation they are the department to contact to enforce property boundaries and assess any fines.
