I look forward to hearing from the author(s) of California Assembly Bill 1404 as to what rights & recourse I — and others like me — have under the new law.
This has been a long & arduous process for me. Losing control of my own private property and being forced to subsidize other people's home ownership has turned my back yard — previously a sanctuary, where I could go to re-charge my batteries, de-stress and exercise — into a source of grievance and incredible stress.
Ours are not large lots. The northwest corner of my wall is located only 26.5 ft to the west of my house. So every time I go outside, I must confront the fact that the court has rendered me impotent, and my blood pressure skyrockets.
I normally swim laps for 40–60 minutes every day this time of year, but no longer feel comfortable spending time in my back garden, and have not gone swimming at all this year, despite the heat and not having A/C.
Clearly, my situation is untenable, and I would like to know once & for all what protections I have under the new law, so that I can decide how I move forward.
